Decisions made

  • Attribution rights supported, but no decision as to length of time.
  • Right of integrity interferes with freedom of speech and should be either abolished or curtailed to the length of term.
  • Treaties that need to be renegotiated should be listed in the Foreign Policy.
  • No staggered rights (rights should stop, not gradually have their scope diminished).
  • Uniform term for all works.

More research

  • Threshold for originality/novelty for creative rights (similar to patent requirement).
  • Addressing DRM/TPMs (discussion ongoing).
  • Orphan works

Ideas canvassed

  • Government body empowered to declare whether a work has been orphaned.
  • Process suggested:
    • Apply for a work to be declared an orphan work.
    • Government body tries to contact the author.
    • After a period it can be declared an orphan work.
  • Might also be available as a defence.
